DEFINE ACTUAL CAUSATION (CAUSE-IN-FACT) IN A NEGLIGENCE ACT.

 

 

Actual causation connects the defendant’s breach of duty to the plaintiff’s injury.

The plaintiff must show that but for the defendant’s negligence, the plaintiff would not have been injured. As long as the plaintiff can establish that more likely than not the defendant’s negligence caused the plaintiff’s injury, the defendant will be liable for the full extent of damages.
