DEFINE CONTRIBUTORY NEGLIGENCE.
Where the plaintiff’s failure to act with due care is, to any degree, responsible for causing the accident in which he suffered harm, the defendant has a complete defense to the plaintiff’s negligence action.
Under contributory negligence, any fault on the part of the plaintiff is a bar to recovery.
Assume pure comparative fault applies (not contributory negligence) unless you are told otherwise.
