WHAT IMPACT DOES A FORESEEABLE INTERVENING FORCE HAVE ON A NEGLIGENT DEFENDANT’S LIABILITY?

 

 

 

As a general rule, a defendant will be held liable for harm caused by foreseeable intervening forces. The chain of proximate causation is unbroken, and the original defendant remains liable.

An example of a foreseeable intervening force is subsequent medical malpractice, including aggravation of the plaintiff’s condition.
