WHAT STANDARD OF CARE ARE CHILDREN HELD TO?
In the majority of jurisdictions, a minor defendant’s conduct is assessed according to what a reasonable child of the same age, education, intelligence, and experience would have done.
Exception: When children engage in inherently dangerous activities (e.g., driving), they are held to an adult standard of care—that of a reasonable, prudent person in the same or similar circumstances.
