MBE® Flashcard

DEFINE LICENSEE AND THE STANDARD OF CARE A LAND POSSESSOR OWES TO A LICENSEE.

A licensee is someone who enters the defendant’s land with the defendant’s express or implied permission, and who is not there for a purpose that benefits the defendant or the defendant’s activities.

The defendant’s land cannot be held open to the public. One example of a licensee is a social guest. The defendant must warn a licensee of known concealed dangers that are not obvious (just warn, not cure).
